2. Services

EditCap provides AI-powered video editing, captioning, transcription, content generation, rendering, and related creative tools.

We may:

• Add, remove, update, or modify features at any time.
• Improve or discontinue Services without prior notice.
• Introduce usage limits, fair-use policies, or plan restrictions.

Results generated by AI depend on user inputs and source content. Accuracy, quality, and suitability are not guaranteed.

3. User Content

You retain ownership of all content uploaded to EditCap ("User Content").

By uploading content, you grant EditCap a limited, non-exclusive license to:

• Store and process your content.
• Generate outputs requested by you.
• Deliver the Services.
• Maintain backups and platform functionality.

You represent and warrant that:

• You own the content or have all necessary rights and permissions.
• Your content does not violate any law, contract, intellectual property right, or third-party right.

4. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes.
• Upload content that infringes copyrights, trademarks, or other rights.
• Upload malicious code, malware, or harmful software.
• Attempt to reverse engineer, copy, resell, or exploit the Services.
• Interfere with platform security or functionality.
• Generate or distribute illegal, abusive, hateful, defamatory, or harmful content.

Violation of these Terms may result in suspension or termination of your account.

5. Subscription & Payments

• Premium features require a paid subscription.
• Subscription fees are billed in advance.
• Plans automatically renew unless canceled before the next billing date.
• By subscribing, you authorize EditCap to charge your selected payment method automatically.
• You are responsible for any taxes, duties, or charges applicable in your jurisdiction.

7. Service Availability

We strive to provide reliable Services but do not guarantee continuous availability, uninterrupted operation, error-free functionality, or compatibility with all devices or platforms.

Scheduled maintenance, technical issues, or third-party service interruptions may affect availability.

8. Termination

We may suspend or terminate your account if you violate these Terms, if your activities create legal, security, or operational risks, or if required by law.

Upon termination, access to the Services may immediately cease, stored projects may be deleted without further notice, and outstanding payment obligations remain enforceable.

9. Intellectual Property

EditCap and all related software, technology, designs, branding, trademarks, and content are owned by EditCap or its licensors.

Except as expressly permitted, no rights are granted to copy, distribute, modify, or create derivative works from the Services.

10. Privacy

Your use of the Services is also governed by our Privacy Policy.

By using EditCap, you consent to the collection and processing of information as described in the Privacy Policy.

11. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, EditCap disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy or reliability of outputs.

We do not guarantee that AI-generated content will be accurate, complete, or suitable for any specific use.

12. Limitation of Liability

To the fullest extent permitted by law:

• EditCap shall not be liable for indirect, incidental, consequential, special, or punitive damages.
• We are not liable for lost profits, lost data, business interruption, or reputational harm.
• Our total liability shall not exceed the amount paid by you to EditCap during the twelve (12) months preceding the claim.

13. Changes to Terms

We may modify these Terms at any time. Updated versions will be posted on this page with a revised "Last Updated" date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
